These Terms & Conditions apply to services provided by Altocom (“Altocom”, “the Service”, “we”, “us”).
By requesting, purchasing or using an Altocom service, you agree to these Terms.
Altocom services are intended for business customers only and are not offered as consumer services.
1. About the Service
Altocom provides managed website and online presence services for businesses.
Services may include:
- website setup and configuration
- website hosting and management
- content updates
- technical maintenance
- use of Altocom network addresses
- connection of supported external services
- related online services
Altocom provides technical, website management and marketing support services only.
Altocom does not provide legal, financial, medical, regulatory or other professional advice.
Altocom websites are intended as marketing and informational websites. They are not intended to operate as business-critical systems or the only method of operating a business.
Customers should maintain alternative methods for important business processes, communications, bookings, payments and customer interactions.
Altocom does not guarantee website traffic, enquiries, sales, search engine rankings or any specific business results.
2. Managed Website Service
Altocom websites are provided as a managed subscription service.
The monthly fee provides access to the managed website service while the subscription remains active.
Customers receive a limited, non-exclusive, non-transferable licence to use the managed website service for their business purposes during an active subscription.
This licence ends automatically when the subscription ends.
3. Ownership and Intellectual Property
Customers retain ownership of their own business materials, including:
- logos
- images
- text
- branding
- customer-provided content
- customer-owned traditional domain names
The website service, technical setup and systems provided by Altocom remain the property of Altocom.
This includes:
- website layouts and structures
- WordPress installations
- themes and templates
- configurations
- hosting environments
- technical infrastructure
- workflows and processes
- systems created or supplied by Altocom
The subscription service does not include transfer or ownership of Altocom website files, templates, configurations or technical systems.
When a subscription ends, access to the managed website service ends and the website may be taken offline.
Altocom is not required to provide website files, backups, databases, templates, configurations or technical materials following cancellation unless separately agreed in writing.
4. Customer Materials
Customers grant Altocom permission to use, edit, process and display customer-provided materials as necessary to provide the Service.
Customers confirm they have all required rights, permissions and licences for materials supplied to Altocom.
Customers are responsible for any claims arising from customer-provided materials.
5. Customer Content and Professional Responsibility
Customers remain fully responsible for all content displayed on their website, regardless of whether the content was:
- supplied by the customer
- prepared by Altocom
- generated using software or artificial intelligence tools
- adapted from templates or examples
This includes but is not limited to:
- business information
- contact details
- professional qualifications
- licences and registrations
- legal or professional statements
- service descriptions
- pricing information
- claims about expertise, experience or results
- images and media
Customers are responsible for reviewing, verifying and approving all website content before publication.
Approval of website content confirms that the customer accepts responsibility for the accuracy, legality and suitability of that content.
Customers operating in regulated industries, including but not limited to legal, financial, property, healthcare or professional services, are solely responsible for ensuring their website complies with all applicable:
- laws
- regulations
- professional standards
- advertising rules
- industry requirements
- licensing obligations
6. Artificial Intelligence and Automated Tools
Altocom may use software tools, automation or artificial intelligence technologies to assist with creating and managing services.
Customers remain responsible for reviewing and approving all website content before publication.
Altocom does not guarantee that automatically generated or assisted content is accurate, complete, compliant or suitable for any specific business or regulated profession.
7. Data Protection
Customers are responsible for ensuring that personal data collected through their website is processed lawfully.
Customers are responsible for appropriate privacy notices, cookie notices and legal disclosures required for their business.
Where Altocom processes personal data on behalf of customers, it will do so only as required to provide and maintain the Service.
8. Content Updates
Small content updates are included as part of managed website subscriptions.
Examples include:
- opening hour changes
- contact information updates
- replacing existing images
- small edits to existing content
Included updates do not cover:
- redesigns
- new functionality
- rebuilding pages
- significant restructuring
- frequent or high-volume changes
Menu changes, catalogue updates, price lists or regularly changing business information may require a separate agreement or additional fees depending on frequency and complexity.
9. Customer Review and Approval
Websites require customer review and approval before launch.
The customer is responsible for checking all content, information and materials before approving publication.
Publication approval confirms that the customer accepts the website content as accurate and suitable for their business.
One reasonable revision round is included unless otherwise agreed.
Additional changes or requests outside the agreed scope may require additional fees.
Customer delays in providing content, information or approvals may delay the project.
10. Payments and Cancellation
Services are billed monthly unless otherwise agreed.
Customers may cancel their subscription at any time.
After cancellation, the Service remains active until the end of the current paid billing period.
Payments already made are non-refundable.
Cancellation does not remove responsibility for unpaid fees incurred before cancellation.
After the subscription ends, the managed website service stops and the website may be taken offline.
11. Failed Payments
If payment cannot be collected, services may be suspended.
If payment remains outstanding for more than 60 days, associated website content and configurations may be permanently removed.
Where reasonably practical, Altocom may provide notice before permanent deletion.
12. Price Changes
Altocom may change subscription prices.
Existing customers will receive at least 30 days notice before pricing changes take effect.
13. Availability and Security
Altocom aims to provide reliable and secure services.
However, continuous availability cannot be guaranteed.
Altocom does not provide a specific uptime guarantee unless agreed separately in writing.
Altocom is not responsible for:
- temporary website unavailability
- lost enquiries
- lost bookings
- lost revenue
- loss of business opportunities
Altocom applies reasonable security practices but cannot guarantee that websites, software or third-party systems will be free from vulnerabilities, attacks or unauthorised access.
14. Traffic and Resource Usage
Altocom services are designed for normal small business website usage.
If a website creates unusually high resource usage, Altocom may apply technical protections, require changes, recommend another setup or temporarily restrict access to protect service stability.
15. Third-Party Services
Altocom services may depend on third-party providers including hosting companies, registrars, software providers, WordPress themes, plugins, analytics tools and external integrations.
Altocom is not responsible for failures, changes, restrictions or discontinuation of third-party services.
16. Network Addresses
Altocom may provide access to industry-specific addresses or other Altocom-controlled network addresses.
These addresses are provided only as part of the Altocom service.
They are not traditional domain registrations purchased by the customer.
Customers receive permission to use them only while the related subscription remains active.
Customers obtain no ownership, transfer rights or permanent rights to Altocom-controlled addresses.
17. External Services Connected to Network Addresses
Altocom network addresses may be configured to connect, redirect or resolve to supported third-party services.
Supported third-party services are selected by Altocom and may change over time.
Altocom may add, remove or discontinue support for external services due to technical, security, legal, commercial or service quality reasons.
Customers acknowledge that third-party services are outside Altocom’s control and continued compatibility cannot be guaranteed.
18. Customer Domains
Customers may use their own domains with Altocom services where technically possible.
Domains already owned by customers remain the property and responsibility of the customer.
If Altocom registers a traditional domain name on behalf of a customer at the customer’s request, the domain belongs to the customer and may be transferred upon request, provided outstanding domain-related fees have been paid.
Altocom will not prevent customers from transferring customer-owned domains away from Altocom.
This does not apply to Altocom network addresses, industry-specific addresses, subdomains or other addresses provided as part of the Altocom managed service.
19. Acceptable Use
Services must not be used for illegal, fraudulent, harmful, abusive or disruptive activities.
Altocom may suspend or terminate services immediately if unacceptable use is detected.
20. Customer Indemnity
Customers agree to indemnify Altocom against claims, costs or losses arising from:
- website content
- customer materials
- professional claims or statements
- infringement of third-party rights
- unlawful use of services
- inaccurate customer information
- failure to comply with laws, regulations or professional obligations
21. Changes or Discontinuation
Altocom may modify, replace or discontinue services.
Where reasonably possible, customers will receive 30 days notice before planned discontinuation.
Immediate changes may occur due to security issues, legal requirements, abuse, non-payment or third-party changes.
22. Force Majeure
Altocom is not responsible for failure or delay caused by events outside reasonable control.
23. Portfolio Use
Unless otherwise agreed, Altocom may reference completed websites, customer business names and examples of work for portfolio, demonstration and promotional purposes.
24. Limitation of Liability
To the maximum extent permitted by law, Altocom’s liability is limited to fees paid by the customer during the three months before the event giving rise to the claim.
Altocom is not liable for indirect losses including lost revenue, lost customers, lost opportunities, loss of data or reputational damage.
Nothing in these Terms excludes liability where exclusion is not permitted by law.
25. Governing Law
These Terms are governed by the laws of Ireland.
Any disputes will be handled under Irish law.
